BeautyBoss Suite SaaS Product

QCMD Marketing

1. Introduction

BeautyBoss Suite is a product owned and operated by QCMD Marketing Pty Ltd (South Africa) and QCMD Marketing Ltd (UK) (together “QCMD Marketing”).

By signing up, trialing, or using BeautyBoss Suite, you (“the Client”) agree to these Terms & Conditions.

2. Plans & Pricing

Basic Plan: R595/month

Professional Plan: R1,495/month

Premium Plan: R2,950/month

Features are as described on the official website and may evolve with notice.

Calendars are included; advanced booking system is optional.

Social Planner in Premium covers up to 7 accounts, not unlimited.

Domain costs are billed separately as third-party services.

3. Trials, Billing & Renewals

5-Day Free Trial: Requires card on file; automatic billing begins on day 6.

A reminder email/SMS/WhatsApp will be sent 24 hours before the trial ends.

30-Day Money-Back Guarantee: Covers subscription fees only; excludes top-ups, domains, ads, and third-party charges. Valid once per customer, on the first subscription.
No Contracts

Billing renews monthly by default.

Cancellation: 30 days’ notice required.

Failed Payments: After 3 retries, accounts may be paused; after 14 days, accounts may be terminated.

4. Usage-Based Wallet

Covers WhatsApp conversations, SMS, emails over quota, and other metered services.

Pricing is USD-based and subject to change by providers.

Clients set their own reload thresholds and amounts.

Once credits run out, service will stop immediately (hard stop).

QCMD Marketing is not responsible for lost messages due to insufficient balances.

5. WhatsApp Business & Messaging Compliance

QCMD integrates via LeadConnector (HighLevel).

Client responsibilities:

Obtain valid opt-in.

Use approved WhatsApp templates.

Comply with WhatsApp Business Terms and Messaging Policy.

Accept that Meta may limit or suspend messaging based on quality ratings.

QCMD Marketing will not be held liable for policy breaches or account suspensions.

6. Data Protection (POPIA & GDPR)

QCMD acts as Processor/Operator; Clients are the Controller/Responsible Party.

Core data processing terms are embedded in these T&Cs.

Data may be stored/transferred outside South Africa/UK using reputable sub-processors with appropriate safeguards.

QCMD maintains reasonable technical and organisational measures but cannot guarantee absolute security.

7. Acceptable Use Policy

Prohibited: illegal, fraudulent, hateful, violent, adult, gambling, firearms, or harmful content.

Clients must not misuse the platform in ways that could disrupt service for others.

META sets and enforces WhatsApp daily messaging limits.

8. Service Levels & Support

Basic: Standard support (email/WhatsApp, business hours Mon–Fri, 9:00–17:00 SAST).

Professional: Priority support (email, WhatsApp, calls, Zoom). Clients may be asked to provide Loom videos for troubleshooting.

Premium: Priority support + strategy sessions.

No SLA is provided (no contracts); uptime depends on third-party providers.

9. Intellectual Property & Marketing Rights

Clients retain ownership of their data and content.

QCMD retains ownership of all software, systems, and IP.

Unless opted out, QCMD may use client logos/testimonials for marketing purposes.

10. Websites, Domains & Ads

Domains: Registration/renewal/SSL are separate costs billed to clients.

Ads Manager (Premium): Media spend is paid directly to Meta/Google.

QCMD Marketing is not liable for ad account bans, disapprovals, or campaign performance.

Clients are responsible for DNS access, ad compliance, and web content legality.

11. Termination, Suspension & Data Export

Accounts may be suspended/terminated immediately for:

AUP violations,

Non-payment,

Breaches of WhatsApp/Meta policies,

Data protection violations.

On termination, client data will remain available for 30 days for export before permanent deletion.

12. Liability & Disclaimers

QCMD is not liable for:

WhatsApp or Meta restrictions,

Third-party service interruptions,

Lost profits, indirect or incidental damages.

Maximum liability is limited to the subscription fees paid by the client in the last 3 months.

13. Governing Law & Jurisdiction

These T&Cs are governed by the laws of South Africa (Western Cape, Cape Town Magistrate’s Court).

For UK clients, QCMD Marketing Ltd (UK) is the contracting entity, governed by English law.
